Subordinate Judiciary in India

The subordinate judiciary constitutes a very important segment of the judicial system as it is in these courts that the judiciary comes in close connect with the people. It is backbone of Indian judicial system. Provisions in Article 233 to 237 to regulate the organization of these courts and to ensure independence of the subordinate judges. The Supreme Court has through its various decisions promoted the independence of these courts from executive control and, to this effect, has expanded the control of the High Courts over the subordinate judiciary, so as to strengthen the independence of the subordinate courts from executive control. To protect these courts, the Supreme Court has assumed power to punish contempt of these courts. Likewise, a High Court can also do so. Disciplinary action cannot be initiated against a subordinate judge for just for delivering a wrong decision on making a wrong order.
